DMCA Copyright Policy
In accordance with the Digital Millennium Copyright Act (DMCA), we have adopted the following policy regarding copyright infringement. We reserve the right to:
- Block access to or remove copyrighted material that we believe has been illegally copied and distributed by any of our advertisers, affiliates, content providers, members, or users.
- Terminate service for repeat offenders who are found to be infringing copyrighted content.
Your use of [email protected] services is always subject to our Terms of Service, which includes this Copyright Dispute Policy. Any terms used in this policy that are not explicitly defined will have the meanings assigned to them in the Terms of Service.
Procedure for Reporting Copyright Infringement
If you believe that material accessible through our Services infringes your copyright (or the copyright of someone you are authorized to represent), please send a DMCA notice of copyright infringement containing the following information to our Designated Agent:
- A physical or electronic signature of a person authorized to act on behalf of the copyright owner.
- Identification of the copyrighted work(s) that have been infringed.
- Identification of the infringing material (including specific details such as URLs or locations on our platform) so that we can locate and verify its existence.
- A statement that you have a good faith belief that the use of the material is unauthorized by the copyright owner, its agent, or the law.
- Your contact information, including your full name, address, phone number, and email (if available).
- A statement, made under penalty of perjury, that the information provided is accurate and that you are authorized to act on behalf of the copyright owner.
Once a valid infringement notice is received, we reserve the right to:
Terminate the content provider’s account if they are a repeat offender.
Procedure for Filing a Counter-Notice
If you believe that the removed or disabled material is not infringing, or that you have the legal right to use such material (via authorization from the copyright owner, a legal exception, or otherwise), you may file a Counter-Notice by providing the following information to our Designated Agent:
- A physical or electronic signature of the content provider.
- Identification of the material that was removed or to which access was disabled, and the location where it previously appeared.
- A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled due to a mistake or misidentification.
- Your contact information, including your name, address, phone number, and email (if available).
- A statement consenting to the jurisdiction of the relevant courts:
- If you are based in the U.S., you must consent to the jurisdiction of the federal court in your district.
- If you are outside the U.S., you must consent to the jurisdiction of any judicial district in which [email protected] operates.
Upon receipt of a valid Counter-Notice, we may, at our discretion:
Restore the removed material or cease disabling access to it within 10-14 business days, unless the copyright owner files a legal action seeking a court order to prevent this.
